I've learned this grammar "on paper" but I'm not experienced enough with it to offer much information beyond what you already wrote. From my understanding の is optional, for example 天候いかんでは or 天候のいかんでは are functionally equivalent. I believe it is the same for いかんによらず/いかんにかかわらず. However, I am not positive.
Seeing as I only learned いかんで without は, I'm curious as to what difference adding the particle makes.

If it helps, this grammar can be spelled 如何, with no relation to 遺憾. It's one of those obscure points that you have to fish around for before you actually find in a real life context. So far I might've seen it twice outside of the merry world of textbookland. (which is still ahead of おいてをや!)
